GENERAL TERMS AND CONDITIONS

The following general terms and conditions govern the legal relationship between the company Pareus Service GmbH. with registered office in Bolzano, Sparkassenstrasse 18, in its capacity as operator of the beach facility in Caorle, Viale degli Usignoli 150 (hereinafter referred to as “Baia Blu”) and each guest (hereinafter referred to as “customer”) and are in all respects an integral part of the contract concluded between the customer and the Baia Blu beach facility. The client is therefore obliged to read these general conditions carefully.

The Client declares, in the event of accepting a corresponding contractual relationship with Baia Blu and thus concluding a contract in accordance with article 1 below, to accept these general conditions for himself and also for all other Clients staying with him at Baia Blu. Furthermore, he declares that he is authorised to accept the general conditions of this contract for these accompanying persons.

The following General Terms and Conditions govern the legal relationship between the Pareus Service GmbH, with registered office in Bolzano, Sparkassenstrasse 18, in its capacity as operator of the Baia Blu Beach Bar located in Caorle, Viale degli Usignoli 150, and any booking party (hereinafter referred to as the “User”) and are to be understood as supplementary to the terms and conditions of the contract concluded between the User and the www.spiagge.it platform.

The booking submission process allows the User to properly check and correct any errors before confirming the booking, so it is the User’s sole responsibility to ensure that the details of the booking are correct before submission.

The contract with Baia Blu Beach Bar is deemed to have been concluded when a written confirmation of the booking is sent (usually by e-mail with the subject: “Booking Confirmation”). The confirmation entitles the User to use the booked services at Baia Blu Beach Bar as soon as the User arrives there on the booked date.

Changes to an existing booking can be made directly to Baia Blu Beach at the e-mail address: info@baiablubeach.com or by telephone: +39 0421 18 30 361 until 05.00 pm  the day before.

Depending on availability, Baia Blu Beach Bar will propose a new time and/or date. If, due to lack of availability, no changes can be made to the existing booking, the user is entitled to a cancellation of the booking and a refund. Alternatively, a voucher will be issued which can be redeemed for another date (subject to availability).

Baia Blu Beach Bar endeavours to continuously update the internet site and ensure flawless functioning, however it is not liable for technical or other circumstances that are beyond the bar’s control or for restrictions/failures owing to force majeure.

Baia Blu Beach Bar shall also not be liable for inadequate services or for failure to provide services as a consequence of accidental equipment failure or force majeure. It is also not liable for damages caused by other guests or due to force majeure. Force majeure is understood as events beyond the control of both parties (e.g. natural disasters, riots and strikes – insofar as they are at national level – national and local lockdowns due to the Covid-19 pandemic, Covid-19-related illnesses or comparable events which render fulfilment of the contract wholly or partially impossible).

Please note that Baia Blu Beach Bar uses the booking and payment services of the online service provider

and that the direct cancellation of the booking and/or any subsequent refund will be made by this provider in accordance with its general terms and conditions.

The legal relationship between the client and the Baia Blu Beach Bar is governed by Italian law.

With respect to data protection of the Baia Blu Beach Bar, reference is made to the privacy policy.

The General Terms and Conditions for using the services at Baia Blu Beach Bar are available in Italian, German and English. In the event of a contradiction, the Italian version shall prevail.

The Client shall treat all items belonging to the Baia Blu Beach Bar care, caution and vigilance and use them only for their intended purposes. The Client shall be liable for any damages caused by him/herself or his/her accompanying persons, whereby he/she reserves the right to prove that the damages occurred through no fault of his/her own or his/her accompanying persons (intent and all forms of negligence).

The Client also agrees to observe and ensure compliance to all regulations regarding use of the Baia Blu Beach Bar’s services and communal areas, which are continuously adapted and posted for information.

Pursuant to Articles 1341 and 1342 of the Italian Civil Code (Codice civile), when concluding a contract the Client expressly agrees to the General Terms and Conditions for Booking as listed here for him/herself and for any other accompanying persons and third parties for whom he/she has made the contract.
